Terms of Use
These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services (collectively, the "Services") operated by Trufa Health, LLC ("Trufa," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. We reserve the right to update or modify these Terms at any time; continued use of the Services following any changes constitutes your acceptance of the revised Terms.
Trufa's Services facilitate access to healthcare providers, health record management, administrative support, and telehealth communications through affiliated professional entities in our provider network.
Trufa Does Not Provide Medical Services
Trufa operates as a technology platform only. We do not practice medicine, provide medical services, or prescribe medications. Licensed healthcare providers accessible through our platform are employed by or contracted with independent affiliated professional entities — not Trufa.
By accessing a licensed healthcare provider through the Services, you are not entering into a provider-patient relationship with Trufa. The providers you interact with are independent professionals who exercise their own clinical judgment. You are responsible for monitoring and reading all communications sent through the platform.
Availability of Services
Trufa's Services are available to residents of states in which we are authorized to operate. Certain services or treatment options may be available only in specific states. Availability is subject to change at any time without notice.
Eligibility
To use Trufa's Services, you must be at least 18 years of age, located in a state where our Services are available, and legally capable of entering into a binding agreement under these Terms. Meeting these requirements does not guarantee access to any specific service or treatment. Trufa reserves the right to modify eligibility requirements at any time without prior notice.
Requirements for Use
Use of the Services requires a compatible device, reliable internet access, and any necessary software or applications. Standard data and messaging rates from your carrier may apply. You are solely responsible for any fees associated with your device, mobile plan, or internet connection.
Special Consent to Telehealth Services
By using Trufa's platform, you agree to a separate telehealth consent agreement. Telehealth services involve the electronic delivery of healthcare, including the transmission of medical records, audio and video interactions, and the exchange of health information. You acknowledge that telehealth has inherent limitations — your provider will not be able to physically examine you and may not have access to information typically gathered during an in-person visit.
Any diagnosis or treatment recommendation you receive through our platform may be limited or provisional. You assume the risks associated with these limitations. State law may further restrict a provider's authority to prescribe certain medications without a prior in-person examination.
Privacy Policy
Your use of Trufa's Services is also governed by our Privacy Policy and Notice of Privacy Practices, both of which are incorporated into these Terms by reference. Please review these documents carefully to understand how we collect, use, and protect your personal and health information.
GLP-1 and Peptide Health Program Terms
Program Description
Trufa offers a monthly subscription program providing access to weight loss and wellness treatments, including semaglutide, tirzepatide, and peptide compounds. The program includes telehealth access to licensed providers, monthly medication refills at provider discretion, pharmacy fulfillment services, and secure messaging with your care team. This program is not health insurance, does not substitute for health insurance, and does not satisfy any individual health insurance mandate under federal or state law.
Each monthly subscription includes a 30-day medication refill, secure messaging with your healthcare provider, and prescription fulfillment with free expedited shipping through the Trufa Pharmacy Network.
Onboarding and Initial Consultation
New members are required to complete an initial telehealth assessment with a licensed physician or nurse practitioner. Your enrollment begins when your provider communicates your care plan and you acknowledge and elect to proceed. You may be required to complete additional services — such as lab work or primary care consultations — at your own expense before a treatment plan can be established.
Pharmacy Services
You may select from pharmacies within the Trufa Pharmacy Network. By using our Services, you consent to Trufa sharing your personal information, health records, and prescription data with our partner pharmacies as necessary to fulfill your prescriptions.
Packaging Notice
Medications dispensed through our pharmacy partners are not shipped in child-resistant packaging. You are responsible for storing all medications safely and out of reach of children.
No Refund Policy
All sales of prescription products are final. We cannot accept returns of prescription medications. If you believe your order was filled in error, please contact our care team at support@jointrufa.com as soon as possible and we will work to resolve the issue.
Subscription Fees and Billing
Your subscription fee will be presented and confirmed during your initial consultation. Fees are charged automatically to your payment method on a monthly basis (approximately every 28–30 days) until you cancel. Fees are non-refundable once charged for the current billing period.
If you fill a prescription at a local pharmacy outside our network, your subscription fee will not include medication costs. Transferring your prescription to the Trufa Pharmacy Network will add medication and fulfillment costs to your subscription at the next billing cycle. By enrolling, you authorize Trufa or its third-party payment processors to charge all amounts due. Services will not be provided until full payment is received and verified.
No Insurance Billing
Trufa and its affiliated professional entities do not bill health insurance providers. All fees are the sole responsibility of the member. By using our Services, you acknowledge and accept this cash-pay model.
No Medicare or Medicaid — Special Notice
Federal and state healthcare programs, including Medicare and Medicaid, do not cover services provided through Trufa's telehealth platform or bundled program offerings. By enrolling, you acknowledge that you will pay for all services directly and that neither Trufa nor its affiliated entities will submit claims to any federal or state healthcare program on your behalf.
Canceling Your Subscription
You may cancel your subscription at any time before your next prescription is sent to the pharmacy by contacting us at support@jointrufa.com or through your secure patient portal. Fees already charged prior to your cancellation date are non-refundable.
Delaying Your Subscription
You may delay your next billing cycle through your patient portal or by contacting our team. No subscription fee will be charged during your delay period. While delayed, you will not be eligible for medication refills but will retain access to secure messaging. Extended delays may affect your treatment adherence, and your provider may require a follow-up consultation before resuming treatment. If your delay reaches eight (8) consecutive cumulative weeks without scheduling a continuation visit, your subscription may be canceled without further notice.
Pausing Your Subscription
You may pause your subscription by switching to on-demand billing through your patient portal or by contacting our team. No monthly fees will be charged while paused. Your services will remain active through the last day of your most recently paid billing cycle, after which only secure messaging will be available until you resume. As with delays, extended pauses may affect your treatment and may require a provider consultation to restart. If your on-demand period exceeds eight (8) consecutive cumulative weeks without a continuation visit, your subscription may be canceled without notice.
Shipping Policy
Orders are processed within 2–3 business days. Estimated delivery is 4–12 business days from shipment, depending on your location. Delays may occur during holidays or periods of high demand. You will be notified via email or phone if a significant delay is anticipated. Shipping costs are calculated and displayed at checkout.
Shipment Confirmation and Order Tracking
Once your order ships, you will receive a confirmation email with tracking information. Tracking numbers are typically active within 24 hours of shipment.
Domestic Shipping Only
Trufa ships medications within the United States only. We do not fulfill international orders.
Damage During Shipping
Trufa is not liable for products damaged or lost in transit. If your shipment arrives damaged, please contact the carrier directly to file a claim. Retain all original packaging and damaged items for claim documentation purposes.
No Guarantee of Continued Availability
RAPHA MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES REGARDING THE CONTINUED AVAILABILITY OF ANY PROGRAM OR SERVICE. We reserve the right to discontinue any program at our sole discretion. In such cases, we will provide at least 30 days' notice to give you adequate time to arrange alternative care.
Communications by Text Message and Email
By opting in to SMS communications or sending us a text, you consent to receiving messages from Trufa regarding your account, appointments, prescriptions, and services. If you have opted into marketing communications, you may also receive promotional messages.
You represent that you are the owner or authorized user of the mobile device provided and that you are solely responsible for any messaging or data charges from your carrier. Neither Trufa nor mobile carriers are liable for delayed or undelivered messages.
Access to our Services is not conditioned on your consent to receive marketing messages. You may opt out of SMS communications at any time by replying "STOP." Please note that text messages and emails sent through our platform are not encrypted. By using these communication channels, you acknowledge the potential risk of interception and accept responsibility for any information transmitted.
Registration and User Accounts
Certain features of the Trufa platform require registration. You agree to provide accurate, complete, and current information when creating your account and to keep that information updated. Failure to do so may result in suspension or termination of your account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify Trufa immediately at support@jointrufa.com if you suspect unauthorized access or a security breach. You may not transfer, share, or create multiple accounts, or use another person's account. Trufa is not liable for losses resulting from unauthorized account use due to your failure to safeguard your credentials.
Access Rights and Prohibited Use
Trufa grants you a personal, limited, revocable, non-exclusive, non-transferable right to access and use the Services for your own personal, non-commercial purposes, subject to these Terms. Trufa reserves the right to deny or suspend access to any user at any time for any reason.
You may not: (a) impersonate any person or entity; (b) violate any applicable law or regulation; (c) reverse engineer, decompile, or disassemble any software; (d) transmit viruses, malware, or other harmful code; (e) infringe any intellectual property rights; (f) sell, resell, license, or sublicense the Services; (g) develop competing products using our platform; (h) damage, disrupt, or impair our systems; (i) attempt unauthorized access to any part of our platform; (j) remove any proprietary notices; (k) reproduce or distribute content beyond permitted use; or (l) encourage others to do any of the foregoing.
Ownership of Information Submitted
Except for personal health information maintained pursuant to applicable privacy law (including HIPAA), any information you submit to Trufa — other than protected health information — becomes Trufa's non-confidential property and may be used for any lawful purpose, including reproduction, publication, and distribution.
With respect to your personal health information, you grant Trufa and its service providers, successors, affiliated professional entities, and partner pharmacies a fully transferable license to use, copy, reproduce, analyze, modify, and disclose such data to the extent necessary to provide the Services, conduct internal research, and improve our platform and offerings.
Ownership of Site Content
Trufa is the sole and exclusive owner of all content, features, functionality, and intellectual property on our platform. You may not reproduce, publish, distribute, modify, publicly display, or exploit any content from our platform beyond what is required for normal personal use of the Services. All unauthorized use is strictly prohibited.
Termination
These Terms remain in effect for as long as you access or use the Services. You may terminate your use at any time by ceasing all use of the platform. Trufa may terminate or suspend your access at any time, with or without notice, for any reason including a breach of these Terms.
Following termination, Trufa has no further obligation to provide Services except as required by applicable law, professional ethics, or obligations related to your health record access. You agree not to use the Services following termination. Sections relating to disclaimers, liability limitations, indemnification, and governing law survive termination.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RAPHA EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND FREEDOM FROM VIRUSES OR ERRORS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM UNAUTHORIZED ACCESS.
You are solely responsible for evaluating the accuracy and usefulness of any information obtained through our platform. Your use of the Services is at your own risk.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RAPHA, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES — EVEN IF RAPHA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHERE APPLICABLE LAW DOES NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, RAPHA'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Indemnification
You agree to indemnify, defend, and hold harmless Trufa Health, LLC, its affiliates, affiliated professional entities, directors, officers, employees, contractors, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Services, your violation of these Terms, or any fraud or willful misconduct on your part.
Governing Law; Dispute Resolution; Arbitration
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved by final and binding arbitration conducted in New York, New York under the rules of the American Arbitration Association.
Either party may seek injunctive or equitable relief in any court of competent jurisdiction without waiving the right to arbitration. You and Trufa agree that any dispute resolution proceedings will be conducted on an individual basis — not as a class or representative action.
If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
No Waiver
Trufa's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver of any term shall be effective unless made in writing.
No Agency Relationship
Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and Trufa. You are not authorized to enter into any agreement or incur any obligation on Trufa's behalf.
Assignment
You may not assign your rights or obligations under these Terms to any third party; any attempted assignment is null and void. Trufa may transfer its rights and obligations under these Terms in connection with a merger, acquisition, or sale of substantially all of its assets without your consent or further notice.
